  • It sounds like they found something out that triggered them to ask for the Note. Does the seller have any funds to come to the Table with? See if they will allow the selller to bring 5k if they say no go to 6k, then 7k then 8k max. Tell them the seller wants to be done with this now and doesn't want to pay 10 or 15 years because they don't know what the future brings and they don't know if they will be able to pay this down the road. Tell them that the seller wants to pay the 5k to 8k now and be done with it no notes. If the seller can't come to closing with the 5k to 8k you will have to ask the buyer to pay the 5k to 8k to make it work. If the buyer is getting a good deal it shouldn't be a problem. The Bank just wants to see that the seller is willing to make some kind of contribution to the deal. If they say no make the argument that there is no guarantee that the seller is going to pay your note in full. They could stop paying it down the road and you end up with 1k or 2k or nothing. We want to settle this account now but we are limited to how much we can pay. We can pay you 5k guaranteed money at closing and this will be done. I hope this helps you out. Joe

    Well it not up to me. But I think there needs to be a better way to sell homes like this.

    We preserve the homes, market, send the packets and attempt to sell the home for the seller an we believe that the lender appreciates this since it avoids them the cost of foreclosure.

    It is apparent that this is not the case and maybe were not actually helping anybody, including the lender. We aren't really making any money doing this when you consider how long these short sales take. Its around 750 a month.

    Don't know what else to say, but thank you for the update. I will talk to the homeowner tonight around 8pm and I will email you tomorrow. Did you send me an attachment of what they need to sign ig they agree?

    Mike,

    I don't know what to tell you at this point. Mgt has made their decision, and if the homeowner cannot accept the prom note options that I have given you, there is nothing more I can do for this file, except close it out. what would you like for me to do?

    My hands are tied, and cannot go any further with this until the homeowner makes their decision....

    Well they don't.

    It just seems that they want to make these deals impossible to sell.

    Half of them I've had for over a year, then you get someone to talk to and this is the bs they tell you.

    They are loosing that other property. Its not even listed and its underwater too.

    Mike,

    I just got some news from mgt regarding the short sale for: "Torres".

    In order for this file to continue on, and for it to have any chance of getting an approval, mgt is asking for a prom note of $16,500.

    Here are the terms:

    1st option: 10 year prom note, (No Interest), fixed rate, $137.50/mo, starting in aug 3rd, 2009
    2nd option: 15 year prom note, (No interest), fixed rate, $91.67/mo, also starting in aug 3rd.

    Please keep in mind that the homeowner must accept one of the above options to keep this file alive, otherwise the file will be closed out.

    Also, after checking the credit report, I need for the sellers to give me a letter of explanation on the other mortgage that they have. . .

    there is an indy mac loan, the b of a 2nd lien, and a b of a home equity( which she is current, and a line of credit available).

    I need that letter as well to present to mgt, signed and dated from mr. torres.

    Please advise at your earliest convenience!
